TERMS AND CONDITIONS OF USE OF WEBSITE AND ONLINE PURCHASES

  1. General
    1. This website is operated by Caythorpe Farm Limited. The content of this website is intended to provide you with information about our products and our company. It is also intended to provide you with the opportunity to purchase our products. These terms and conditions apply to the use of our website by you and to any purchase of wine, cherries or other products which are effected through our website.
    2. We reserve the right to change these terms and conditions from time to time, which may be in the form of a notice on our website Caythorpe.nz
    3. If we fail to enforce or exercise our rights under these terms and conditions at any time, we have not waived those rights.
  2. Online Purchases - Wine
    1. It is illegal for us to sell our wine to anyone who is under the age of 18, or for anyone under the age of 18 to consume our wine. If you are under the age of 18, we cannot sell our wines to you and you must not misrepresent your age in order to purchase our wine.
    2. When you enter the wine section of this website, you are required to verify your age so that we can be assured that we can legally sell wine to you. We then ask you to reconfirm your age at the time of ordering via checking the terms and conditions checkbox on the order confirmation page. If we have any doubt about your age, we are entitled to request proof of your age, such as a copy of your driver's licence or passport.
    3. We can only deliver to a New Zealand address - no international shipping.
    4. You must supply a physical street address to allow us to deliver your order. We cannot deliver to PO boxes.
    5. We will endeavour to deliver your products within 3-4 business days of placing an order. Deliveries will not be made at weekends or public holidays.
    6. All prices shown are in New Zealand Dollars and are inclusive of Goods and Service Tax. We reserve the right to adjust our prices at any time.
    7. Once and order has been placed it cannot be cancelled - you will be charged for the order. Before confirming payment please ensure all your details are correct.
    8. We hope that you will love our products. If you have any issues with our products please contact us immediately at info@caythorpe.nz and we will endeavour to sort the problem out for you.
  3. Online Purchases - Cherries
    1. As cherries are a seasonal produce all orders are subject to availability. If for any reason product is not available we will endeavour to notify the non-availability on our website and remove the option to purchase. We reserve the right to do this at our discretion and at any time.
    2. We can only deliver to a New Zealand address - no international shipping.  
    3. You must supply a physical street address to allow us to deliver your order - we cannot deliver to P.O. boxes. Due to the time delay involved with rural delivery and the perishable nature of cherries, we are also unable to deliver to RD addresses.
    4. All products will be dispatched in the best condition possible and our courier will endeavour to deliver overnight to the address stipulated. Due to excessive freight volumes in the lead up to Christmas, we cannot guarantee overnight delivery. Any orders that are not delivered overnight will be kept chilled by our courier.
    5. You will be sent an automated email with courier tracking details once your order is dispatched.
    6. Please ensure someone will be present at the time of delivery - we cannot take responsibility for degradation of product if otherwise.
    7. Deliveries will be made Tues-Fri. Deliveries will not be made at weekends or on public holidays.
    8. Our boxes are 2kg in size and all orders will be multiples of 2kg.
    9. All prices shown are in New Zealand Dollars and are inclusive of Goods and Service Tax. We reserve the right to adjust our prices at any time.
    10. Once and order has been placed it cannot be cancelled - you will be charged for the order. Before confirming payment please ensure all your details are correct.
    11. As cherries are perishable we are not able to accept returned produce.

  4. Privacy Policy
    1. When you enter this website, purchase product from us or subscribe to any newsletters or promotional materials you will give us personal information about yourself. By providing this information, we have your consent to holding this information for its own purposes. We will not give this personal information to any third party without your consent unless we are required to by law.
  5. Email Policy
    1. If you have subscribed for newsletters or promotional materials and you no longer wish to receive them, please email info@caythorpe.nz with "unsubscribe" in the subject line.

    1. We are a New Zealand organisation and any disputes you have with us over these terms and conditions, including any disputes over products purchased through our website, are subject to New Zealand law.
